In 2010, the Florida Legislature passed a new law (SB2234) to regulate the Mold Inspection and Mold Remediation Industry in Port Orange and other cities across the state. Before this, some businesses that engaged in both assessment, or testing, and remediation and removal of mold were taking advantage of customers.
As an example, one of these businesses performed a mold test in a Port Orange home that was certain to come up positive. The owner or an employee used the false positive to strong-arm homeowners into using their company to remove the mold, often starting that same day to begin immediately charging cleaning and removal fees. Once demolition and removal of property begin, this can mean thousands of dollars in repair and replacement costs alone. Today, a company that is licensed to perform mold assessment testing cannot even be licensed to perform mold remediation. The differences are defined by SB2234:
Mold assessment testing is the process, performed or supervised by a mold assessor, which includes taking physical samples and gathering detailed information on a building's history to determine the location, origin, and extent of any mold growth with an area greater than ten feet square. The assessor also determines the specific type of mold, when possible or indeed, even applicable to the discovery.
Mold remediation refers to the process of cleaning, demolition, removal, and sanitization of mold or mold-contaminated structural and personal property greater than ten square feet not purposefully grown at that location by a mold remediator. Additionally, every assessment and remediation business must also maintain at least a one million dollar insurance policy of general liability coverage. The policy is in case of errors in testing or damage not related to remediation. Each licensed business is listed in the Florida Department of Business & Professional Regulation website so customers can verify their authorization to work before hiring them.
